Petitioner seeks quashing of FIR No.0329/2023 of PS Delhi Cantt for offence under Section 279/338 IPC on the ground that complainant de facto (respondent no.2) has settled the disputes with the petitioner. 2.
Petitioner as well as respondent no. 2, both identified by IO/ASI Vishan Pal Singh are present in Court. I have spoken with both of them in Hindi. settlement amount, which is in addition to the compensation already received by him in proceedings before Motor Accident Claims Tribunal. Respondent no. 2 submits that he does not wish to pursue prosecution of the petitioner. State has no serious objection to this petition. 3.
The petition is allowed and accordingly, FIR No.0329/2023 of PS Delhi Cantt for offence under Section 279/338 IPC and proceedings arising out of the same are quashed. The pending application also stands disposed of.
