O R D E R

% 07.05.2024 CRL.M.A. 13041/2024 (modification of order dated 15.03.2024) 1.

The present application under Section 445 read with Section 482 of the Cr.P.C. seeks the following prayers:- "In view of the facts and circumstances mentioned herein above, it is most humbly prayed that this Hon'ble Court may graciously be pleased to:

a) modify order dated 15.03.2024 to the extent that petitioner be released on his furnishing personal bond in the sum of Rs.10,000/- or cash security to the satisfaction of Jail Superintendent in lieu of furnishing personal bond in the sum of Rs. 10,000/- with one surety of the like amount to the satisfaction of the jail Superintendent; or b) pass any other order or further order(s) which this Hon'ble Court may kindly deem fit and proper in the facts and circumstances of the case and in the interest of justice."

concerned Jail Superintendent as to whether the present applicant/petitioner has been released on furnishing his personal bond with cash security of the said amount.

A report has been received from Deputy Superintendent, Central Jail No. 2, Tihar, New Delhi dated 05.05.2024, wherein it has been stated that the present applicant/petitioner has been released on furlough on 26.09.2023 for a period of 3 weeks by the competent authority on his furnishing a cash surety of Rs. 10,000/- alongwith a personal bond in the like amount to the satisfaction of the Jail Superintendent, Central Jail No. 2, Delhi. 4.

In view of the above, the present application is partly allowed. Order dated 15.03.2024 is modified to the extent that the applicant/petitioner shall be released on furlough for a period of three weeks from the date of his release on his furnishing a cash surety of Rs. 10,000/- alongwith a personal bond in the like amount to the satisfaction of the concerned Jail Superintendent.

Application is partly allowed and disposed of accordingly. 6.

Order dated 15.03.2024 is modified to the aforesaid extent. 7.

Order be uploaded on the website of this Court, forthwith. 8.

Copy of the order be sent to the concerned Jail Superintendent for necessary information and compliance.
