The present Appeal has been filed under Section 173 of the Motor Vehicle Act, 1988 for enhancement of the compensation amount in respect of judgment dated 04.10.2018 [hereinafter referred to as "Impugned Judgment"] passed by the learned Presiding Officer, MACT, Shahdara, Karkardooma Courts, Delhi. By the Impugned Judgment, a compensation in the sum of Rs. 16,75,000/- along with interest at the rate of 9% per annum has been awarded to the Appellant.

Learned Counsel for the parties jointly submit that the matter was settled in the National Lok Adalat on 08.03.2025. Learned Counsel for the Appellant and Respondent No.3 submit that in terms of the settlement, the Appellant is entitled to enhanced compensation in the sum of Rs. 3 lakhs over and above, the amount awarded by the learned Tribunal as full and final compensation. Pursuant thereto, Respondent No.3 was directed to deposit a sum of Rs. 3 lakhs within a period of six weeks. The report of the Registry is that the payment has since been deposited, in view thereof, an Application has been filed seeking release of compensation payable to Respondent No.4, since Respondent No.4 has expired, to be paid to the Appellant, who is the wife of the Respondent No.4. 4.
Since the matter has been settled, let the compensation payable to the Respondent No.4 be released in favour of the Appellant. 5.
Accordingly, the Appeal is disposed of. All pending Applications also stand closed.
