% 08.04.2024 Learned counsel for the petitioner submits that application for bail was dismissed by learned Trial Court vide impugned order dated 15.01.2024 since certain material witnesses, namely Mother of deceased, first caller who had given the information, PW Rashid, Sunil (husband of PW9, Madhu) were yet to be examined at the aforesaid stage.

He further states that since the aforesaid material witnesses have now been examined before the learned Trial Court, present application may be permitted to be withdrawn with liberty to approach the learned Trial Court afresh.

Taking the statement of learned counsel for the petitioner on record, application is accordingly disposed of with liberty to approach learned Trial Court and without expressing any opinion on the merits of the case. Pending applications, if any, also stand disposed of. ANOOP KUMAR MENDIRATTA, J.
