Application under Section 528 of the Bharatiya Nagrik Suraksha Sanhita, 2023 ("BNSS") has been filed on behalf of the Petitioner for clarification of Order dated 19.02.2025 passed by this Court, wherein, sentence of the Petitioner was stayed subject to deposit of Rs.1,00,000/- within 15 days.

Respondent appears on advance Notice and accepts Notice. 4.

It is submitted that Petitioner has already deposited Rs.1,95,600/-, which is 20% of the cheque amount, before the learned Trial Court and therefore, the condition of depositing Rs.1,00,000/- be waived of. 5.

Submissions heard and record perused.

Fine of Rs.9,78,000/- was imposed on the Petitioner and even if, he has deposited Rs.1,95,600/-, which is 20% of the said amount, does not merit any further modification of depositing Rs.1,00,000/-. because this amount is subject to the outcome of the judgment and does not mean that the amount be released to the Complainant. There is no clarification merited in the impugned order.
