The learned counsel appearing for the petitioner does not press this petition at this stage, as the final report has not been filed by the State. He seeks permission of this Court to withdraw the present petition. 2.

The learned APP for the State, on instructions from the concerned Investigating Officer (IO) states that the final report will be positively filed within one month from date.

Accordingly, the present petition along with the pending application is dismissed as withdrawn, with liberty to the petitioner to file a fresh petition, in case need so arises.
