The present writ petition has been filed seeking a direction to the respondents no.1 and 2/MCD to inspect the unauthorized balcony constructed by the respondent no.4 and take appropriate action, including sealing and demolition.

The petitioner has placed on record photographs to show the unauthorized balcony having being constructed. 3.

Issue notice.

Notice is accepted by the counsel appearing on behalf of the respondents no.1 to 3.

and 2/MCD submits that the subject property has been inspected this morning and it is found that the entire building has been constructed in an unauthorized manner.

5.1 He submits that appropriate action in accordance with law shall be taken in respect of the said building.

Accordingly, the present writ petition is disposed of while directing the respondent-MCD to take appropriate action in accordance with law, after complying with all statutory requirements.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.

8.

All rights, contentions and legal remedies of the private respondent/occupier shall remain protected.
