W.P.(C) 189/2020 & CM No.565/2020 (Stay) This petition has been filed challenging the order dated 09.04.2019 passed by the Appellate Authority under the Insecticides Act, 1968 dismissing the appeal filed by the petitioner herein on the ground of limitation. The petitioner further prays for a direction to the respondents to take a decision on the applications of the petitioner with respect to the registration of chemicals as mentioned in paragraph 8 of the Writ Petition. This Court in a similar petition being WP(C) 9328/2019, titled M/s Agro Pack v. Union of India & Anr; has allowed a similar prayer directing the respondents to take a decision on the application of the petitioner therein within four weeks.
In view of the order passed in the other petition, the present petition is allowed directing the respondents to take a decision on the applications of the petitioner for registration of the chemicals as mentioned in paragraph 8 of the Writ Petition, within a period of eight weeks from the communication of this order.
Needless to say, if the petitioner is aggrieved of the decision taken by the Registration Committee, it shall be open to the petitioner to seek its remedy against it in accordance with law.
