The petitioner/wife is seeking initiation of contempt proceedings against the respondent/husband for wilful disobedience in not complying with the directions contained in the order dated 29.10.2022 passed by the learned Judge, Family Court, North District, Rohini Courts, Delhi, whereby she has been granted maintenance @ Rs. 9,000/- per month, from the date of filing of the petition i.e. 12.08.2016 till 30.06.2017 and thereafter @ Rs. 15,000/- per month w.e.f. 01.07.2017 for a period of life time or till she re-marries with stipulation to increase the maintenance by 5% p.a. started from 01.07.2018.

During the course of the arguments, it is pointed out that an execution proceeding is pending before the learned Judge, Family Court and an order has been passed on 20.03.2024, whereby the respondent/husband has been directed to make payment of Rs. The matter is stated to be listed for further hearing/compliance before the learned Judge, Family Court on 01.08.2024. Since the impugned order passed by the learned Judge, Family Court, is an executable order and the Court is already seized of the matter, the instant contempt petition before this Court is disposed of without prejudice.
