O R D E R

The present bail application has been filed under Section 439 seeking bail in FIR No.41/2019 under Sections 420/120B IPC registered at Police Station Mayur Vihar, Delhi.

Learned counsel for the petitioner submits that the petitioner has been in judicial custody since 27.07.2019. He submits that an amount of Rs.1,77,271/- has been transacted in his account. He further submits that without prejudice to his rights and contentions, the petitioner is ready and willing to pay the said amount to the complainants within a period of two weeks. He further submits that the charge-sheet has already been filed against the present petitioner.

Learned APP for the State, on the other hand, has vehemently opposed the bail application. He submits that the investigation qua role of other co-accused is still pending.

Learned counsel for the petitioner submits that the petitioner is ready and willing to provide one local surety.

In view of the facts and circumstances of the case and the fact that the petitioner is in custody since 27.07.2019, the petitioner is admitted to bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the trial court and subject to the following conditions:- (i) The petitioner shall pay an amount of Rs.1,77,271/- to the complainants within a period of two weeks.

(ii) The petitioner shall not directly or indirectly make any inducement, threat or promises to the complainant or any witness during the trial or tamper with the evidence. (iii) The petitioner shall provide the I.O./SHO Police Station Mayur Vihar, Delhi with his mobile phone number and in the event of change of his residential address, shall inform the same to the concerned I.O./SHO.

(iv) The petitioner shall remain regularly present before the Trial Court.

With the above directions, the bail application is disposed of. DASTI.
