% 24.01.2019 By this petition, the petitioner seeks parole on the ground that the surgery of uretric calculus of the mother is to be performed and the petitioner has to look after her.
A status report and nominal roll have been handed over which are taken on record. As per the status report though the medical documents of the petitioner could not be verified because of the non-availability of the concerned dealing hand of the hospital, namely, Action Medical Institute, Paschim Vihar, however, the family of the petitioner comprises of his mother and one brother as well.
Learned counsel for the petitioner fairly admits that the petitioner has a brother.
Thus in case surgery of the petitioner's mother is to be performed the brother of the petitioner can look after the mother. Further the parole is W.P.(CRL) 228/2019
strongly opposed on the ground that when the petitioner was earlier granted furlough by the Competent Authority w.e.f. 16th October, 2017, he misused the said concession and during the said period FIR No. 321/2017 under Sections 392/397/412/120B/34 IPC and Section 25 of the Arms Act has been registered against the petitioner.
Considering the previous conduct of the petitioner and that the brother of the petitioner can look after the mother, this Court finds no ground to grant parole to the petitioner.
Petition is dismissed.
