The present writ petition has been filed seeking a direction to respondents/MCD to demolish the illegal construction raised by respondent No.4 in property No. 610, Kundwala Chowk, Delhi - 110006. 2.

Counsel appearing on behalf of the respondent-MCD submits that they have inspected the subject property and it has wrongly been stated in paragraph 2 of the writ petition that the petitioner stays 50 mtrs. away from the construction site. In reality, the petitioner stays 1.5 kms away from the subject property.

In any event, it is submitted on behalf of respondent/MCD that the property in question has been booked for unauthorised construction and a Show Cause Notice has been issued on 11th March, 2026. Subsequently, on the same date, a Work Stop Notice has also been issued to the concerned SHO to ensure that no further unauthorised construction is carried out. 4.

Taking into account the aforesaid submission, the present writ petition is disposed of while directing respondent-MCD to take appropriate action in accordance with law.

All rights, contentions and legal remedies of the private respondent are kept open.
