The Petitioner's grievance emerges from the orders dated 15th May, 2025 and 3rd June, 2025 issued by the Forensic Science Laboratory, Respondent No. 2, whereby the Petitioner's candidature for the post of Senior Scientific Assistant (Document) has been cancelled. 2.

At the outset, Mrs. Avnish Ahlawat, SC for Respondents No. 1, 2 & 4, has raised a preliminary objection regarding the maintainability of the present petition. It is submitted that the dispute pertains to service matters involving entities such as FSL as well as the Bureau of Indian Standards, both of which are notified authorities under the Administrative Tribunals Act, 1985. Accordingly, it is contended that the appropriate forum for adjudication would be the Central Administrative Tribunal.1 1 "CAT"

Ms. Saahila Lamba, counsel for the Petitioner, fairly submits that the Petitioner has no objection to approaching the CAT. She, however, submits that the Petitioner had earlier approached this Court by way of W.P.(C) 3145/2025, which was entertained and disposed of with certain directions to the Respondent authorities.

On this aspect, Mrs. Ahlawat submits that the earlier petition had been disposed of at the threshold itself and therefore no objection regarding jurisdiction was raised at that stage. However, it is submitted that the present dispute would squarely fall within the jurisdiction of CAT. 5.

In light of the foregoing, leave and liberty, as prayed for by Ms. Lamba, are granted. The Court has not commented on the merits of the case. All rights and contentions of the parties are left open. 6.

Dismissed as withdrawn with the liberty as aforesaid. 7.
