Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking directions for quashing of FIR, Charge-Sheet and consequential proceedings arising out of FIR No. 92/2020 under Section 420 of the Indian Penal Code, registered at Police Station Connaught Place, New Delhi.

It is pointed out by the learned Prosecutor that the FIR got registered pursuant to the directions issued by the learned Metropolitan Magistrate under 156(3). ASJ. Thereafter, it got challenged before this Court. Because the ChargeSheet had already been filed, the Petition was disposed of with the observations that now the Petition for quashing of FIR has become infructuous. It is fairly conceded that the Charges have already been framed against the Petitioner and the evidence of the Prosecution is ongoing. One witness has already been examined. Once the Petitioner has not sought it necessary to challenge the Order on Charge and the trial is already on-going, no in between the quashing of the Charge-Sheet is merited. Whatever is the defense stated in the Petition, can be taken by the Petitioner during the trial. 3.
No merit in the present Petition, which is hereby dismissed. 4.
The Petition is disposed of accordingly. Pending Application, if any, also stands disposed of.
