O R D E R

% 10.01.2020 The present petition challenges the order dated 17th December, 2019 passed by the ld. ADJ in the appeal challenging the judgment/decree dated 18th November, 2019. By the said judgement, a decree for eviction was passed and payment of mesne profits was also directed. The Appellate Court, at the time of granting stay, directed the Tenant to deposit a sum of Rs.5 Lakhs in the form of FDR. Ld. counsel for the Petitioner/Tenant submits that the amount of Rs.12,780/- was not to be paid on per month basis but the Tenant was to pay Rs.1065/- per month, hence there is an error in the decree. He seeks permission to withdraw the present petition with liberty to avail his legal remedies as may be available in law.

The present petition is dismissed as withdrawn with liberty to the Petitioner to avail legal remedies in accordance with law. However, the said liberty shall not be construed as a permitting the Petitioner to not comply with the impugned order dated 17th December, 2019. The pending applications also stand dismissed.
