The petitioner has filed the present execution petition seeking to enforce an award dated 07.08.2017 passed by Central Government Industrial Tribunal cum Labour Court No.1, Karkardooma Court Complex, Delhi. It is seen that the said award is already the subject matter of challenge before the Uttrakhand High Court at Nainital and the said Court has already granted stay of the said award. The learned counsel appearing for the petitioner states that the said stay is not operative as the wages directed to be paid under Section 17-B of the Industrial Disputes Act, 1947 have not been paid. 2.

In the given circumstances, this Court considers it apposite that the petitioner obtains a specific clarification from the Uttrakhand High Court before initiating any further proceedings for enforcement of the award. It would also be apposite for the petitioner to agitate her grievance regarding non-payment of wages under Section 17-B of the said Act before the

Uttrakhand High Court at Nainital in the pending matter. 3.

The petition is disposed of with liberty to the petitioner to take appropriate steps for enforcement of the award as and when the matter is finally disposed of by the Uttrakhand High Court or an appropriate clarification is issued in this regard.
