This transfer petition has been filed by the petitioner seeking transfer of Case No.7919/2016 titled as 'Narender Kumar Vs. State & Ors.' presently pending in the Court of Sh.Nipun Awasthi, ACJ/CCJ/ARC (East), Karkardooma Courts, Delhi to the Court of Sh.Jai Thareja, ACJ/CCJ/ARC (Shahdara), Karkardooma Courts, Delhi where Succession Petition No.9810/2016 titled as 'Kanta Vs. State & Ors.' filed by the respondent No.6 is already pending.

Respondents have been served and counsel as above appeared on their behalf. Learned counsel for the respondent Nos.2 to 6 submits that they have no objection if the prayer of the petitioner is allowed and Case No.7919/2016 titled as 'Narender Kumar Vs. State & Ors.' presently TR.P.(C.) 7/2017

pending in the Court of Sh.Nipun Awasthi, ACJ/CCJ/ARC (East), Karkardooma Courts, Delhi is transferred to the Court of Sh.Jai Thareja, ACJ/CCJ/ARC (Shahdara), Karkardooma Courts, Delhi where Succession Petition No.9810/2016 titled as 'Kanta Vs. State & Ors.' filed by the respondent No.6 is already pending.

In view of the above submissions made by learned counsel for the parties, Case No.7919/2016 titled as 'Narender Kumar Vs. State & Ors.' is withdrawn from the Court of Sh.Nipun Awasthi, ACJ/CCJ/ARC (East), Karkardooma Courts, Delhi and is assigned/transferred to the Court of Sh.Jai Thareja, ACJ/CCJ/ARC (Shahdara), Karkardooma Courts, Delhi where Succession Petition No.9810/2016 titled as 'Kanta Vs. State & Ors.' filed by the respondent No.6 is already pending, for disposal in accordance with law.

It is submitted that next date of hearing in one of the connected matter i.e. Succession Petition No.9810/2016 pending before the Court of Sh.Jai Thareja, ACJ/CCJ/ARC (Shahdara), Karkardooma Courts, Delhi is 24th May, 2017.

Parties are directed to appear before the transferee Court on 24th May, 2017.

The petition stands disposed of in above terms. 7.

Copy of the order be given dasti to learned counsel for the parties. 8.

A copy of this order be also sent to the Courts concerned through concerned District & Sessions Judge.
