% 23.01.2019 W.P.(C) No. 750/2019 & CM APPL. No. 3275/2019 (for interim relief) The grievance in the present petition is that on 14.12.2018, respondent No. 1 (BSES Yamuna Power Limited) disconnected the electricity supply and removed the electricity meter installed at premises No. 207-A/1 IVth Floor, Than Singh Nagar, Anand Parbat, New Delhi, which the petitioner occupies claiming to be a tenant under respondent No. 2.

The petitioner's representation for restoring the electricity connection made on 19.12.2018 to respondent No. 1 remains unanswered. The petitioner has thereafter made an application for grant of an independent electricity connection by application No. 8003692045 dated 07.01.2019.

The petitioner says she has been orally informed by officers of

respondent No. 1 that her request for a new connection will not be accepted since she has not provided 'property papers' and a 'noobjection' certificate from her landlord/respondent No. 2. However application dated 07.01.2019 is still pending with respondent No. 1. Learned counsel for the petitioner contends that disconnection was made at the instance of respondent No. 2, who wants the petitioner to vacate the tenanted premises. He further contends that the petitioner is occupying the subject premises under a Security Agreement dated 28.03.2016 ; and that is the only document in evidence of her occupation of the said premises, apart from her Aadhar Card containing the same address.

Since respondent No. 1 has not yet officially considered nor granted/denied the electricity connection to the petitioner formally in writing, let respondent No. 1 consider and act upon the petitioner's application dated 07.01.2019 aforesaid, within a period of two weeks under written intimation to the petitioner. Thereupon the petitioner shall be at liberty to seek her remedies in accordance with law. This petition is disposed of in the above terms. Order dasti.
