The present writ petition under Article 226 and 227 of the Constitution of India seeks to assail the order dated 12.02.2024 passed by the learned Central Administrative Tribunal in O.A.2163/2023. Vide the impugned order, the learned Tribunal has dismissed the petitioner's original application wherein he had assailed the order dated 18.05.2023 transferring him from Delhi to NAD (Vizag).

he has instructions not to press the present petition but prays that taking into account that the petitioner is getting married on 26.02.2024, he may be granted additional joining time. He submits that as per movement order, the time granted to the petitioner to join service at Vizag is expiring on 27/28.02.2024, and therefore, prays that two weeks' additional time to join at Vizag be granted to him.

Despite advance service, none appears for the respondents. Taking into account the limited prayer now being made by the petitioner we are of the view that on account of the petitioner's impending marriage his prayer for further two weeks' joining time deserves to be allowed. The writ petition is, accordingly, dismissed as withdrawn by directing the respondents to grant the petitioner further two weeks' time to join his place of posting at Vizag. This additional period would, however, be excluded from the leave due to him.
