% 08.02.2019 After some hearing, the learned counsel for the petitioner, on instructions, submits that he may be allowed to withdraw the present petition and the application filed therewith, directed against order declining the prayer under Section 156(3) of the Code of Criminal Procedure, 1973 (Cr.P.C.), the petitioner seeking liberty to make fresh prayer before the trial court for investigation by police when the matter reaches the stage of inquiry under Section 202 Cr.P.C.

The petition and the application filed therewith are dismissed as withdrawn, with liberty as prayed for granted. R.K.GAUBA, J.
