This writ petition is filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking limited direction to the Respondents to declare the result of the Petitioner for Semesters V and VI for B.COM (Hons.) Course.

Counter affidavit has been filed by Delhi University in which it is stated that Petitioner appeared in the I and II Semesters examinations held in November-December, 2017 and May-June, 2018, respectively and passed both the Semesters. He then appeared in III Semester examination held in November-December, 2018 but got Essential Repeat ('ER') in paper codes 22411302 and 22413301. He then appeared in IV Semester examination held in May-June, 2019 but was declared failed due to not clearing 50% subjects in III and IV Semesters. As a result, Petitioner was not promoted to V Semester as per Ordinance of University of Delhi, which provides in the Promotion Rules that a student shall be eligible for promotion from 1st year The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

to 2nd year/III Semester provided he/she has passed 50% papers of I and II Semesters taken together and similarly for promotion from 2nd year to 3rd year/V Semester.

It is further stated in the affidavit that Petitioner was not eligible to give V Semester examination in session November-December, 2019 as IV Semester examination result showed that he had failed. Albeit the Petitioner was eligible to give III Semester examination only, he appeared for V Semester examination in November-December, 2019. His result for III Semester remained unchanged and he again appeared in IV Semester Open Book Examination held in May-June, 2020 and passed the same with SGPA-6.29 and was promoted to 3rd year i.e., V Semester. At this stage, Petitioner was eligible to give V Semester examination in session November-December, 2020 but he did not fill the examination form and/or deposit the fee and appeared in the examination without being eligible. In light of this, while the Petitioner on his own appeared in VI Semester examination, his result for V and VI Semesters has been withheld. 4.

Faced with this situation, counsel for the Petitioner submits that he seeks a limited relief that the result of V and VI Semesters be known to the Petitioner so that further steps can be taken towards completing the B.COM (Hons.) Degree Course.

Mr. Rupal hands over the sealed cover containing the result of the Petitioner for V and VI Semesters. Result is perused and the envelope is handed back to Mr. Rupal.

This writ petition is disposed of directing Delhi University to hand over the result to the Petitioner. It is, however, made clear that the declaration of result will not create any right in favour of the Petitioner and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

needless to state that he will have to follow the applicable Promotion Rules for acquiring the B.COM (Hons.) Degree. The mere fact that result has been disclosed to the Petitioner will not amount to any expression on the merits of the case and/or his having failed in some semesters or having appeared in some without being eligible, as brought forth by the Delhi University in the counter affidavit.
