% 19.03.2019

1. Mr. A.S. Chandhiok, learned Senior Counsel appearing for the Respondents/Contemnors states that the Respondents have filed an affidavit on 11th February 2019 before the learned Single Judge in the pending Cont.CAS. No. 670/2015, which is listed for hearing on 27th March 2019.

2. Counsel for the Petitioner points out that the issue that arises for consideration in the contempt case is whether the amount which is due to the Petitioners in terms of the 6th Pay Commission recommendations has been correctly computed. He suggests that the Education Department should be asked to place before the learned Single Judge the correct computation of the dues so that there is no controversy as to exact amount that is payable to

the Petitioner.

3. The Court accordingly directs that the Department of Education will appear before the learned Single Judge when the matter is listed next on 27th March 2019 and place before the learned Single Judge the correct computation of the amount due to the Petitioner as a result of the pay revision brought about by the 6th Pay Commission.

4. The Court is informed that the Petitioner has filed W.P.(C) 3206/2016 on the above issue which is pending before the learned Single Judge on the 'Service Roster'. The Court directs that both the contempt petition as well as the said writ petition be heard by the same learned Single Judge, so that no conflicting orders are passed.

5. Consequently, on 27th March 2019 W.P.(C) 3206/2016 will also be listed along with Cont.CAS. No. 670/2015, subject to the orders of the Hon'ble Chief Justice.

6. The appeal is disposed of with the aforesaid directions. S.MURALIDHAR, J I.S.MEHTA, J MARCH 19, 2019 nd
