O R D E R

% 10.01.2020 By this writ petition, the petitioner seeks a declaration that the order dated 19.12.2019 passed by the Chief Engineer for termination of the agreement is illegal and unlawful.

Learned counsel for the respondent states that no termination order has been passed and the same is still pending approval of the concerned authority.

It is clear that for the time being the present writ petition is premature. At this stage, learned counsel for the petitioner seeks liberty to withdraw this writ petition with liberty to challenge the termination order, if any such order is passed.

He however requests that an opportunity be

granted to the petitioner to make a representation to the Commissioner of the respondent/North DMC before a final decision is taken by the respondent. The petition is dismissed as withdrawn with liberty as sought for. Liberty is also granted to the petitioner to make a representation to the Commissioner, North DMC within 10 days from today. In case such a representation is filed by the petitioner, the Commissioner North DMC is requested to look into the same and pass appropriate orders as per law. Dasti.
