with petitioners in person versus THE STATE GOVT OF NCT OF DELHI & ANR..... Respondents Through Mr. M.P. Singh, APP with W/SI Santosh Sirohi, P.S. Kalyan Puri for respondent no. 1 Respondent no. 2 in person
CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 16.01.2018 It is submitted that petitioner no. 1 (husband) and respondent no. 2 (wife) have started living together after settling their disputes amicably; therefore, FIR No.635/2015 under Sections 498-A/406/34 IPC registered at Police Station Kalyanpuri, registered on the complaint of respondent no. 2, may be quashed.
Respondent no. 2 is present in Court and has been identified by W/SI Santosh Sirohi, Police Station Kalyanpuri. Respondent no. 2 admits having settled the matter with the petitioner no. 1 of her own free will and without any undue force, pressure or coercion and is living
with him for the last two years. She further submits that she is not willing to pursue the FIR any further against of the petitioner no. 1 and his relatives, that is, petitioner nos. 2 to 6 and the same may be quashed. Keeping in mind that husband and wife have resolved their differences and have started living together, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, FIR No.635/2015 under Sections 498-A/406/34 IPC registered at Police Station Kalyanpuri and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
Miscellaneous applications are disposed of as infructuous. Dasti. A.K. PATHAK, J.
