The present petition has been filed by the Petitioner-Nutan under Article 226 of the Constitution of India, inter alia, seeking issuance of an appropriate writ directing the Respondents to conduct the survey of the Petitioner and issue her a Certificate of Vending (hereinafter, 'CoV') 3.

The Petitioner claims that she is an eligible vendor at the Gujrati Market, Janpath New Delhi since 1989 and her name is in the list of eligible vendors. According to the Petitioner, she did not participate in the survey conducted by the New Delhi Municipal Council (hereinafter, 'NDMC'). The Petitioner further makes various allegations against the Town Vending Committee (hereinafter, 'TVC').

The case of the Petitioner is that her name has not been included in the recently conducted survey which has been concluded in July, 2025. The prayer in the present petition is that the survey should be conducted and the CoV ought to be issued to the Petitioner.

Ld. Counsel for the NDMC submits that the survey already stands concluded and the Petitioner now cannot be permitted to ask for re-opening of the survey.

Heard. A perusal of the record would show that the case of the Petitioner is that she was part of the eligible applicants list at serial no. 239. If that was so, there was no reason why the Petitioner did not participate in the survey which was conducted in the Janpath area. There was nothing that prevented the Petitioner from participating in the recently conducted survey. 7.

In the opinion of this Court, after having not participated in the survey, the Petitioner cannot seek directions at this stage. 8.

It is, however, made clear that if there is any claim which the Petitioner wishes to pursue under Section 4(2) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act 2014, the Petitioner is free to do so and the same shall be dealt in accordance with law in any future survey conducted by the NDMC.

The petition is disposed of in the above terms. Pending applications, if any, are also disposed of.
