% 06.08.2024 CRL.M.A. 23176/2024 (under Section 438 of BNSS for modification of terms and conditions of order dated 20.05.2024) 1.

The present application has been filed by the petitioner seeking limited modification of the order dated 20.05.2024 whereby the petitioner was directed to be released on parole for a period of six weeks from the date of his release subject to his furnishing a Personal Bond in the sum of Rs. 10,000/- and one Surety Bond of the like amount to the satisfaction of the Jail Superintendent, further subject to the conditions stated therein. The learned counsel for the petitioner / applicant submits that the petitioner is in custody for the last 14 years and he has lost all his social ties and thus, the petitioner is not in a position to arrange for the Surety Bond. 3.

It is not in dispute that the petitioner is in custody for the past 14 years and 09 months. Thus, there appears to be substance in the submission of the learned counsel that the petitioner has lost all his social ties and is not in a position to arrange for the Surety Bond.

The petitioner was granted parole by this Court vide order dated 20.05.2024 and since then the petitioner has not been able to avail the same for the want of a Surety Bond.

In view of the above, this Court is of the opinion that the order dated 20.05.2024 deserves to be modified.

Accordingly, it is directed that the petitioner be released on parole for a period of six weeks from the date of his release subject to his furnishing Personal Bond in the sum of Rs. 10,000/-. The condition of furnishing Surety Bond is dispensed with.

With the aforesaid modification the present application is disposed of. 8.

Copy of the order be forwarded to the concerned Jail Superintendent for necessary compliance and information.
