Heard the learned Counsel for the Parties.

By instituting the proceedings of the instant Public Interest Litigation Petition, a prayer has been made seeking direction to the Respondents and all concerned departments to undertake cleaning and sanitation of an area near Ashram Metro Station, Gate No. 3 and the adjoining footpaths. Several prayers have been made such as making provision for public toilet facility, installation of CCTV camera, putting up of proper signage and visible warnings dissuading and prohibiting public urination in the area. 3.

Maintenance of proper sanitation and provision for public toilet facility is a statutory duty cast on the authorities including the municipal corporation concerned and the authorities maintaining such rules. The learned Counsel representing Respondent No. 1 / Municipal Corporation of Delhi ("MCD"), on instructions, has stated that the area in relation to which the instant Petition has been filed is maintained by the Public Works Department ("PWD") and accordingly, a letter dated 23.02.2026 has been written by the Executive Engineer (M)-I, Central Zone of the MCD to the concerned Executive Engineer of the PWD of the Delhi Government for providing space for construction of urinal block beneath foot over bridge near Gate No. 3, Ashram Metro Station. The copy of the said letter dated 23.02.2026 has been tendered, which is taken on record. 5.

It has also been supplied to Mr. Sameer Vashisht, learned CGSC representing Respondent No. 2 / Delhi Government. 6.

In view of the aforesaid, and also having regard to the contents of the letter dated 23.02.2026, the instant Petition is disposed of with the direction to the concerned officers of the PWD of the Delhi Government to immediately take note of the letter dated 23.02.2026 and provide the possible space to MCD for construction of public toilet at the area or any adjoining area, mentioned in the letter dated 23.02.2026. 7.

As soon as the land for construction of public toilet is made available to the MCD, construction shall immediately be started and necessary approval for such construction shall immediately be granted by all the authorities concerned. The construction shall be completed within a period of four months from the date of availability of space. 8.

In the interregnum i.e., till the construction of public toilet is made, the MCD shall provide the facility of mobile toilets at an appropriate place and will also ensure that an appropriate cleaning of the area has done and sanitation is maintained.

The Writ Petition stands disposed of with the aforesaid observations and directions.
