Petitioner seeks quashing of FIR No. 760/2022 dated 24.12.2022, registered at police station Kalkaji for commission of offences under Section 376/323 IPC.

Petitioner is, reportedly, close relative of respondent no. 2 and it is contended that allegations appearing in the abovesaid FIR are baseless as these are made in the fit of anger.

Learned counsel for petitioner submits that despite the fact that victim has not uttered even a single word against the petitioner or for that matter with respect to any sexual assault committed upon her, charge-sheet has, though, been filed against him. He, however, submits that charges are yet to be ascertained.

petition with liberty to raise all the contentions before the learned Trial Court at the time of consideration of charge. He also seeks liberty to file the petition afresh in case need so arises.

Liberty, as prayed, is granted.
