CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

% 18.01.2017 Crl. M.A. 951/2017 Allowed, subject to all just exceptions.

Application is disposed of.

W.P.(CRL) 157/2017 Petitioner no.1 and respondent no.2 have settled their disputes before the Family Court, North District (Rohini) on 3rd March, 2015. Marriage between the petitioner no.1 and respondent no.2 has also been dissolved by a decree of divorce by mutual consent on 2nd July, 2016. Respondent no.2 is present in Court and admits having received the entire settled amount. Respondent no.2 has no objection in case the FIR is quashed. Keeping in mind that petitioner no.1 and respondent no.2 have

decided to part their ways, inasmuch as, their marriage has been dissolved by a decree of divorce, I am of the view that no fruitful purpose would be served in keeping them entangled in present criminal proceedings. Accordingly, FIR 246/2013 under Sections 498-A/406/34 IPC registered at police station Swaroop Nagar and the consequent proceedings emanating therefrom are quashed.

Writ petition is disposed of in the above terms. A.K. PATHAK, J.
