This application has been filed on behalf of the Applicant under Section 439 Cr.P.C. read with Section 482 Cr.P.C. for grant of interim bail for four weeks in case FIR No.286/2023 dated 08.05.2023 under Sections 302/34 IPC and Sections 25/27/54/59 of the Arms Act, 1959 registered at PS: Govind Puri, on the ground that Applicant has to facilitate the school admission of his child, both by his physical presence and financially. On the insistence and assertion of learned counsel for the Applicant, this Court had passed a detailed order on 23.02.2024, relevant paragraphs of which read as BAIL APPLN. 670/2024 Page 1 of 3 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

under:- "4. Learned counsel for the Applicant submits that the Applicant be released on interim bail for four weeks to facilitate the admission of his child in school. It is stated that application forms have been filled for Balvantray Mehta Vidya Bhawan, Anguridevi Shersingh Memorial Academy, G.K.-II, New Delhi-110048 as well as St. Columbus National School, Charmwood Village, Surajkund, Faridabad, Haryana. Plain reading of the forms annexed to the application, allegedly for admission of the child, does not indicate clearly as to when the same were uploaded and/or submitted physically and in fact, the document at page 100 is only a blank form.

7. Let the status report be filed before the next date, after carrying out verification of the application forms submitted for admission to the aforementioned schools. It is made clear to the learned counsel for the Applicant that in case any of the documents filed with the application turn out to be false, consequences in law will follow." 4.

The context of the abovementioned observations was that during the course of hearing of the bail application, upon perusal of the admission forms appended to the application, it prima facie appeared to the Court that the forms were not genuine. Learned counsel had, however, insisted that the documents were genuine and could be sent for verification and the Court had warned that if the documents were found to be false and fabricated, consequences in law will follow.

Status Report has been filed on behalf of the State regarding verification of the admission forms of the son of the Applicant, as appended with the application. It is stated in the report that the documents pertaining to St. Columbus National School, Charmwood Village, Surajkund, Faridabad, Haryana and Balvantray Mehta Vidya Bhawan, Anguridevi Shersingh Memorial Academy, G.K.-II, New Delhi were sent to the respective schools to verify whether the application/admission forms had BAIL APPLN. 670/2024 Page 2 of 3 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

been submitted on behalf of the child. The schools have confirmed that no such admission forms are available in their records. Communications received by the concerned SHO from both the schools have been annexed to the Status Report.

Having perused the Status Report, learned counsel for the Applicant tenders unconditional apology and seeks to withdraw the application for interim bail. He further states that applicant be pardoned and it is assured that applicant will never indulge in a similar act in future. 7.

There can be no doubt that filing forged documents in a Court is a serious matter. However, considering that the applicant is apologetic and has tendered unconditional apology, Court refrains from taking any action in the present matter. Applicant is, however, warned to be careful and cautious in future while filing pleadings and/or documents in any Court. 8.

Application is disposed of as withdrawn with the aforesaid caution to the applicant.
