% 25.01.2019 Crl.M.A.1739/2019 (Exemptions) Allowed, subject to all just exceptions.

CRL.M.C. 407/2019 and CRL.M.A. 1738/2019 (Stay) In Case No. ECIR/11/DLZO/2016, under Sections 3 & 4 of Prevention of Money Laundering Act, 2002, impugned order of 7th January, 2019 has directed the issuance of non-bailable warrants against petitioner, as his name figures in the supplementary chargesheet/complaint.

Quashing of impugned order is sought by petitioner's counsel on the ground that petitioner undertakes to appear before the trial court on 6th March, 2019 to furnish bail bonds in terms as directed by the trial court. While taking on record the aforesaid undertaking, impugned order Crl.M.C. 407/2019

so far it directs issuance of non-bailable warrants, is modified. It is made clear that if for any reason whatsoever, petitioner fails to appear before the trial court on the date fixed i.e. 6th March, 2019, then the trial court shall be within its right to issue non-bailable warrants against petitioner. With aforesaid directions, this petition and application are accordingly disposed of.

A copy of this order be given dasti under the signatures of Court Master to learned counsel for the parties.
