O R D E R

% 06.02.2020 Present petition is filed under Section 438 read with Section 482 Cr.P.C. for grant of anticipatory bail in FIR No. 612/2019 dated 01.12.2019 registered at P.S. Harsh Vihar for offences punishable under Section 498A/304B/34 IPC.

The case of the petitioner is that he has been falsely implicated in above noted case by complainant, who is father of the deceased, and petitioner has not committed any offence as alleged in FIR. Learned counsel appearing on behalf of complainant submits that demand of dowry made by the husband of deceased was under pressure of petitioner and the said fact has been stated in supplementary statement recorded under Section 161 Cr.P.C. The death has taken place within 7 years

of marriage due to atrocities committed by petitioner and his family members. Thus, petition deserves to be dismissed. Facts remain, which are not in dispute, in FIR allegations are only against husband of the deceased. Present petitioner is father-in-law of the deceased and there is no allegation against him in FIR. Therefore, without commenting on the merits of the prosecution case, I am of the view that petitioner deserves anticipatory bail.

Accordingly, IO is directed that in the event of arrest, the petitioner be released on bail on his furnishing personal bond in the sum of ₹20,000/- with one surety of the like amount to its satisfaction. The application stands allowed and disposed of. Dasti.
