Mr. Vivek, Advocate for the respondent stated that the respondent has received the vacant possession of the tenanted premises in execution of warrant of possession issued in execution petition bearing no. 445/23 titled as Delhi Gandhi Smarak Nidhi V Rakesh Bansal in accordance with law. It is further stated that the execution proceedings have already been concluded after satisfaction of the decree dated 02.09.2022 vide order dated 31.05.2024 passed by the court of Sh. Anurag Thakur, SCJ-cum-RC, East, Karkardooma Courts, Delhi.

This Court has already taken the view in the judgment dated 26.07.2024 passed in RC.REV. 284/2023 titled as Om Prakash Ashok Kumar & Sons V Shri Ajay Khurana that if the possession of the tenanted premises is restored back to the landlord in execution of warrant of possession, then the revision petition is not maintainable.
