% 23.09.2015 Plaintiff has filed this suit for recovery of Rs.25,65,000/- against the defendant. IA no. 10541/1997 was filed by the defendant for staying the suit on the ground that a case had been registered with the BIFR under Section 22 of the Sick Industrial Companies (Special Provisions) Act, 1985. Vide order dated 14th September, 1998 suit proceedings were stayed sine die with liberty to the plaintiff to get it revived as and when occasion arises. 17 years have passed since then. However, plaintiff has not approached this Court for revival of the suit. Accordingly, suit is disposed of with liberty to the plaintiff to get it revived, if necessary.
