The present petition has been filed to challenge the summoning order dated 19.08.2019 of learned MM in CC No.10895/2018. 2.

After some arguments, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file it before the Court of learned ASJ in accordance with law. 3.

Needless to say that he may seek benefit of limitation for the duration for which the case was pending in the High Court. 4.
