The present petition under Sections 2(b)/10/11 and 12(4) of the Contempt of Courts Act, seeks the following prayers: "a) Initiate contempt of court proceedings against the Respondent Nos. 2 & 3 and punish them for willfully and deliberately disobeying their undertaking in judgment dt. 22.11.2022 delivered by the Ld. Trial Court in CC (NI Act) No. 1973/2022 and undertaking given in Mediation Settlement dt.10.11.2022 in Mediation No. 2567/2022 in terms of Section 10 and 11 of the Contempt of Courts Act,1971; and b) Hold Respondent Nos. 2 and 3 guilty of committing contempt of court and punish them with simple imprisonment for a term of six
(6) months and with a fine of ₹2,000/- (Rupees Two Thousand Only) u/s 12(1) and 12(4) of the Contempt of Courts Act, 1971 as regards the gravity of contempt committed by the Respondents; and c) Pass such other or further orders as this Hon'ble Court may deem fit, just and proper in the facts and circumstances of the case." Learned counsel for the petitioner submits that they have received the principal amount and the interest component has been waived of and they have no further grievance and seeks leave to withdraw the present petition. 4.
