% 01.09.2017 It is submitted that petitioner and respondent no.2 have settled their disputes amicably, therefore, FIR No. 206/06 under Sections 103/104 of the Trade Mark Act and under Section 63 of the Copyright Act registered at police station I.P. Estate on the complaint of respondent no.2 may be quashed. Terms of settlement have been incorporated in IA No. 14790/16 in CS(OS) 1328/17 which has been allowed and suit has been decreed by the learned Single Judge of this Court vide order dated 29th November, 2016. Photocopy of the certified copy of the order dated 29th November, 2016 passed in CS (OS) 1328/2017 has been placed on record. Mr. Bansi P. Gajjar, Executive Director of respondent no.2 is present in Court along with his counsel.

Mr. Bansi submits that settlement has

indeed been arrived at between the petitioner and respondent no.2, therefore, respondent no.2 is not willing to purse the FIR and the same may be quashed.

Keeping in mind the settlement arrived at between the petitioner and respondent no.2 which has already been accepted by this Court in CS (OS) 1328/2017, in the interest of justice, FIR No. 206/06 under Sections 103/104 of the Trade Mark Act and under Section 63 of the Copyright Act registered at police station I.P. Estate and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Miscellaneous application is disposed of as infructuous.
