% 11.03.2019 Ld. counsel for the respondent draws advertence to the order dated 10.01.2019 passed by the Financial Commissioner, Delhi, which forms part of the paper-book and reads, as under :

"10.01.2019 Mentioned today by Shri N.S. Dalal, Counsel for the Petitioner.

1. Counsel for the petitioner filed revision petition under Section 187 of DLR Act against the order 18.12.2018 passed by SDM/RA, Narela. Counsel for petitioner requested to stay the operation of the impugned order dated 18.12.2018.

2. Heard the Counsel for petitioner. Status quo to be maintained by both the parties till the next date of hearing.

3. Issue Dasti notice to respondents through petitioner to file reply before the next date of hearing, on filing of PF.

4. Copy of this order be given Dasti as requested by the Counsel for petitioner.

5. Adj. to 26.03.2019.

In view of such order passed by the Financial Commissioner, Delhi, it is submitted that the instant writ petition, in any eventuality, does not survive. In the submission of ld. Counsel for the respondent, the landlord having initiated the proceedings before the Revenue Authority and the status quo order having been passed by the Financial commissioner, the cause of action to maintain the instant petition does not survive in any case. In view of such submission, ld. Counsel for the petitioner seeks to withdraw the petition. Petition is therefore, dismissed as withdrawn, accordingly. A. K. CHAWLA, J MARCH 11, 2019 rc
