Learned counsel for the parties submit that the inter-se disputes have been amicably resolved and the terms of settlement have been reduced into writing vide a Settlement Agreement dated 02.04.2026. The Settlement Agreement dated 02.04.2026 has been transmitted by the Delhi High Court Mediation & Conciliation Centre.

Learned counsel the plaintiff submits that in terms of para (b) of the terms of settlement, the defendant has undertaken to withdraw the Trade Mark applications for SUUN/SUUNAYURVEDA bearing nos.5497261, 6429043 and 7062533 within a period of four weeks from the date of settlement. 3.
Similarly, para (h) of the Settlement Agreement also stipulates that the products and the packaging material under the impugned packaging, which are in the custody of Amazon and the defendant including the products available in the custody of e-commerce websites, enumerated in the table appended below, would be recalled within four weeks from the date of settlement: CS(COMM) 222/2026 Page 1 of 4 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The defendant further undertook that the repacking/labelling of the recalled products shall be carried out in the presence of the plaintiff or its authorised representative, of which an advance notice of one week would be given to the plaintiff.

Para (k) of the Settlement Agreement also provides that the defendant has undertaken to provide the details of the websites/applications/pages/ accounts of the listing in the social media or in e-commerce or in trade which are enumerated in a table in para (k), and para (l) stipulate that the aforesaid listings as enumerated in para (k) as also the website www.suunayurveda.com shall be taken down within 4 weeks from the date of settlement. 6.
So far as the compliances in para (n) is concerned, learned counsel for the defendants submits that they have moved an application seeking amendment of the name in the Ministry of Corporate Affairs and the GST and PAN etc.

The learned counsel further submits that the details of such information with evidence thereof shall be furnished within four weeks from today to the counsel for the plaintiff.

The compliances as noted in paras (l) and (n) shall be done within the time stipulated therein and an affidavit of compliance shall be filed within six weeks from date. An advance copy thereof shall be furnished to the counsel for the plaintiff.

The Settlement Agreement alongwith its Annexures is taken on record. 10.
The parties are bound by the terms of the settlement. 11.
This Court finds no impediment in case the suit is decreed in terms of the settlement agreement.

The suit is decreed in terms thereof.

The Court Fees as requested be refunded to the plaintiff in terms of Section 16 of the Court Fees Act, 1870 upon completion of all the formalities, as per rules.

The suit is disposed of alongwith all the pending applications. 16.
The next date of hearing fixed before the Joint Registrar (Judl.) i.e. 15.05.2026 stands cancelled.
