After some hearing, learned counsel for the petitioner seeks permission to withdraw the writ petition, in view of the decision of the Supreme Court in Federal Bank Ltd. v. Sagar Thomas and ors, [judgment dated 26.09.2003, (2003) 10 SCC 733], wherein the Supreme Court in the case of a dispute, raised by an employee of the respondent - Federal Bank Limited, has held that writ proceedings will not lie against a private bank. 2.
Mr. Rajat Arora, learned counsel for the respondent - Bank, submits that the petitioner herein was an employee in the Workman Cadre, and would have to approach the Industrial Tribunal at the first instance. That is a matter which the petitioner may consider before invoking any alternative remedies.

The writ petition, alongwith pending application, is dismissed as withdrawn, with liberty to approach the appropriate forum. 4.
The rights and contentions of the parties, in this regard, are reserved.
