+ CRL.M.C. 399/2019 PREM KUMAR@R.K SHARMA AND ANR .... Petitioners Through Mr. Rahul Madan, Adv.

versus STATE (GOVT OF NCT) AND ORS ..... Respondents Through Mr.

Amit Chadha, APP with SI Pritam Singh of police station Darya Ganj Respondent nos. 2 and 3 in person

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 25.01.2019 Notice.

Learned APP accepts notice for respondent no. 1.

Respondent nos.2 and 3, namely, Mr. Lakhveer Choudhary and Mr. Karam Chand are present in Court and accept notice. They have been identified by SI Pritam Singh of police station Darya Ganj. Respondent nos.2 and 3 submit that they have settled the matter with petitioners of their own free will and without any undue force, pressure or coercion before the Delhi Mediation Centre, Tis Hazari Courts, Delhi on 18th April, 2017. Respondent nos. 2 and 3 say that they have received the settled amount from the petitioners and they have no objection in case FIR No.

25/2017 under Sections 419/420/468/34 IPC registered at Police Station Darya Ganj and consequent proceedings emanating therefrom are quashed. Keeping in mind the settlement arrived at between the petitioners and private respondents voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Dasti.
