Petitioner seeks quashing of FIR No.322/2024 of PS Janakpuri for offences under Section 420/467 IPC, which was registered on the complaint of her husband, the respondent no.2 herein. The petitioner as well as respondent no.2 have personally appeared today and have been identified by the IO/SI Ashish. I have spoken with the parties. 3.

Broadly speaking, the present respondent no.2 lodged a police complaint, alleging that his wife, the petitioner herein conspired with a hospital and while undergoing the IVF process she used the ovum of a stranger lady, instead of using her own ovum, thus she cheated him. entering into legal strength of the FIR, for present purposes suffice it to record that it was basically a matrimonial dispute, which has now been resolved by the parties having undergone divorce by mutual consent. The parties have a daughter, being brought up by the petitioner. Towards full and final settlement of all her matrimonial claims, petitioner has received a sum of Rs.21 crores in addition to the amount of Rs.10 crores towards maintenance of daughter of the parties. It is also informed by both sides that investigation is pending.

Considering the above circumstances, I am satisfied that it would be in the interest of justice if parties are not pushed into full fledged trial of the offences alleged. Therefore, the petition is allowed and consequently FIR No.322/2024 of PS Janakpuri for offences under Section 420/467 IPC and the proceedings arising therefrom are quashed. Pending application also stands disposed of.
