The present petition alleges wilful disobedience of the directions contained in the order dated 23.12.2025 passed in W.P.(C) 19559/2025. The said order reads as under:
"3. The present petition has been filed by the petitioner being aggrieved by the fact that there has been a blockage of access to his property bearing no. D-10, Rana Pratap Bagh, Delhi - 110007, due to accumulation of malba/garbage/debris and waste material surrounding the collapsed heritage structure i.e. Mahaldar Khan Garden Gateway and the adjoining DDA land. W.P.(C) 19559/2025.
4. The petitioner alleges that despite repeated representations to the concerned authorities, no remedial action has been taken.

Considering the above circumstances, the present petition is disposed of with a direction that the concerned area shall be inspected by the officials of respondent nos. 1, 2 and 3 in the presence of the petitioner, and any remedial action as may be warranted for removal of the said The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. malba/garbage/debris etc., shall be taken expeditiously.
6. Let the inspection be conducted within a period of 2 weeks from today under intimation to the petitioner. Let the remedial action pursuant thereto, be taken immediately thereafter.

Learned counsel for the MCD, who appears on advance notice, has handed over certain photographs to demonstrate that the directions contained in the aforesaid order has been complied with and the malba/garbage/debris has been substantially removed. The same is clearly borne out from the photographs handed over during the course of hearing. 3.
Learned counsel for the petitioner raises a grievance that the area is not altogether clean and there is some residual debris/waste material lying, although the same is minuscule as compared to the position that was prevalent earlier.

Considering the action taken by the MCD, it is evident that there has been no wilful disobedience of the order dated 23.12.2025 on the part of the MCD.

Be that as it may, the respondent MCD shall make an endeavour to further clean up the area to the extent possible. 6.
The petitioner raises an additional grievance with regard to the dangerous condition of the hazardous structure that stand on the land. The petitioner is at liberty to avail appropriate remedies under law with regard thereto.
