O R D E R

% 25.01.2019 The petitioner's grievance is that inspite of settlement between the parties by way of order dated 08.12.2018 made by the National Lok Adalat, settling all dues towards the electricity connection in the petitioner's premise sat Rs.5,85,179.00, the respondent is now seeking to recover a sum of Rs.7,76,083.57 as late payment surcharge as seen in the latest electricity bill due on 29.01.2019. The petitioner states that he has honoured the settlement made before the National Lok Adalat and has paid all the instalments as were required to be paid till date; and shall also duly pay the balance amount of Rs.4,00,000/- which is due in various instalments upto 30.05.2019.

Issue notice.

Ms. Deboshree Mukherjee, learned counsel appears for Mr. Krishnendu Dutta, learned Standing Counsel for Tata Power Delhi Distribution Limited and accepts notice.

On instructions from the respondent's officer present in court, she states that the late payment surcharge appears in the latest electricity bill by reason only of a technical glitch, since the amounts paid by the petitioner have been accounted for under a separate head. She submits that respondent has no intention to demand, and shall not enforce payment of, the sum showing towards late payment surcharge in the latest electricity bill. The statement made is taken on record.

In view of the statement so made, nothing survives in this writ petition and the same is disposed of as infructuous. Parties shall be bound by the statements made in these proceedings.
