This petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 (in short, 'Cr.P.C.') seeking quashing of the FIR No.0244 of 2018 registered at Police Station: Janak Puri, WestDistrict, Delhi under Section 380/34 of the Indian Penal Code, 1860 (in short, 'IPC') along with all proceedings arising therefrom on the basis of settlement.

The Respondent no.2, who is present in court in person, submits that settlement entered into between the parties was incomplete and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. was not acted upon.

The learned counsel for the petitioner admits that on basis of the settlement, the husband of the respondent no.2 had been granted bail in a cross FIR, being FIR No.96/2018, however, as the respondent no.2 refused to comply with the terms of the alleged Settlement, the bail so granted was later cancelled. He further submits that a civil suit between the parties is also filed seeking cancellation of the Settlement Agreement entered into between the parties.

In view of the above, the very edifice of the present petition does not survive.

Accordingly, the present petition is disposed. 6.
In case, the petitioner wishes to file a petition on merits, the petitioner shall be at liberty to do so, which shall be considered in accordance with law.

The interim order granted to the petitioner vide order dated 29.07.2022, shall continue for a further period of two weeks from today.
