% 16.01.2018 The petitioner seeks anticipatory bail. FIR No. 136/2017 had been registered at PS Nabi Karim under Section 376/120B IPC. Learned counsel for the petitioner at the outset points out his name has not been mentioned by the prosecutrix either in her statement under Section 164 Cr.P.C or in the FIR. This submission is incorrect. The petitioner's name has been named both in the statement under Section 164 Cr.P.C as also in the FIR. The role attributed to the present petitioner is a conspiracy which prima facie hatched by the petitioner and two of his other companions which has left facilitation

of the crime upon the victim. Petitioner had an active role in said incident. No ground is made out for anticipatory protection. Dismissed.
