The present writ petition has been filed by the Petitioners seeking a direction to the Respondents to allow Petitioners, who are currently residing in Seattle, United States of America, to appear through video conferencing before the Registering Authority for the purpose of registration of their marriage.

It is stated that marriage between the Petitioners was solemnized on 10.05.2022 according to Hindu Rites and Customs at Hotel Radisson Blu, Kaushambi, Ghaziabad. It is stated after solemnization of marriage both the Petitioners went back to USA for their professional commitments. It is stated that Petitioner No.1 on 06.01.2024 lost her job due to mass layoffs in USA. It is stated that the Petitioner No.1 was earlier residing in USA on H1B status (employment visa). It is stated now for residing in USA, the Petitioner No.1 has to obtain dependent visa and for which purpose the Certificate of Registration of Marriage is required. 3.

Court to a judgment passed by this Court in Reena Chadha & Anr. v. Government of NCT of Delhi, 2021 SCC Online Del 4336, wherein this Court allowed the Petitioners to appear virtually before the Registering Authority for the purpose of registration of their marriage. 4.

In view of the above, this Court is inclined to allow the present writ petition and permit the Petitioners to appear before the Registering Authority through video conferencing for the purpose of registration of their marriage.

It is submitted by the learned Counsel for the Respondents that in view of the advancement in the technology in Artificial Intelligence, the possibility of somebody impersonating the Petitioners cannot be ruled out and for this purpose Petitioners be directed to appear before the Consulate General of India, San Francisco, California and join the video conferencing from there.

Accordingly, the Petitioners are directed to appear before the Consulate General of India, San Francisco, California and join the video conferencing from there.

The Consulate General of India, San Francisco, California is requested to permit the Petitioners to join through video conferencing for the purpose of registration of their marriage.
