The present Writ Petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, directing the respondents to produce the minor girl of the petitioner.

The learned Standing Counsel hands over a copy of the Status Report dated 09.04.2026. The same is taken on record. 3.

traced and produced before the Child Welfare Committee (CWC) on 06.04.2026, which after due interaction and consideration, has directed her to be kept at Children's Home, Kasturba Balika Ashram, Bakhtawarpur, for her care, protection and well-being. The child has also been produced before the learned Magistrate on 07.04.2026 for recording her statement under Section 183 of the BNSS, wherein she has stated that she left her home of her own free will and that no wrongful act, misconduct, inducement or offence of any nature has been committed against her by any person during the said period. 4.
Keeping in view that the child is now in the protective custody of CWC, no further orders are required to be passed in the present petition.

The learned counsel for the petitioner submits that the mother of the child be given the custody of the child. She may move an appropriate application before the CWC for the same and the CWC shall take an informed decision on the same keeping in view the past record as well.
