The petitioner has moved an application under Order 1 Rule 10 CPC to implead M/s ATS Infrastructure Ltd as Respondent 4. 3.

As M/s ATS Infrastructure Ltd is a necessary party to the settlement, the request is acceded to. M/s ATS Infrastructure Ltd shall stand impleaded as Respondent 4. The parties are represented by their respective counsel. The learned counsel for the parties undertake on behalf of their clients to remain bound by the terms of settlement. The Court has perused the terms of settlement and find them to be in order. As such, dispute does not survive for consideration.
