O R D E R

% 22.01.2020 Petitioner is seeking parole of four weeks to attend the wedding ceremonies of his brother, which are scheduled from 27th January to 31st January, 2020. Petitioner is serving life sentence in FIR No. 20/2011, registered at police station Neb Sarai for the offences under Sections 302/120-B IPC and Sections 25/54/59 of the Arms Act. Learned Additional Standing Counsel for respondent/State submits that factum of marriage of petitioner's brother stands verified but this petition is opposed while drawing attention of this Court to the Nominal Roll dated 13th January, 2020 placed on record which indicates that conduct of petitioner in jail is not satisfactory, as in the year 2015 a mobile phone was recovered from his barrack. Learned Additional Standing Counsel further submits that co-accused of petitioner have not

surrendered after dismissal of appeal on 23rd October, 2019. Learned counsel for petitioner submits that petitioner will abide by the terms and conditions imposed by this Court and sound sureties will be furnished. It is submitted that petitioner's real brother is a Government employee and is working in Irrigation Department and one cousin of petitioner is working in Delhi Police and they will stand as surety for petitioner.

Heard.

A perusal of Nominal Roll dated 13th January, 2020 placed on record reveals that petitioner was earlier released on parole for three weeks under the orders of this Court and he had surrendered in time. In the facts and circumstances of this case, this petition is allowed and petitioner is directed to be released on parole for a period of ten days from the date of his release on his executing a personal bond in the sum of Rs.10,000/- with two sureties in the like amount (as undertaken in preceding paragraph) to the satisfaction of the Jail Superintendent, subject to the following conditions:

i) The petitioner shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working conditions at all the times. The same shall not be changed without prior intimation to the Jail Superintendent;

ii) The petitioner shall report at the local police station to mark his attendance on every alternate day at 11:00 a.m. during the period of parole;

iii) The petitioner shall duly surrender at the end of the period of parole; and iv) The petitioner shall also not indulge in any criminal activity while on parole.

A copy of this order be communicated to the Jail Superintendent. The petition stands disposed of.
